1. Acceptance of Terms

By accessing or using AnalyzeMySong (the "Service"), operated by MusicBiz.Studio ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. These terms apply to all users, including visitors, registered users, and paying customers.

2. Description of Service

AnalyzeMySong is an AI-powered song analysis tool designed for independent artists and music creators. The Service accepts audio file uploads and returns automated analysis including genre positioning, artist comparisons, production feedback, and marketing copy. Analysis is performed using third-party AI technology (Google Gemini API).

We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice where practicable.

3. User Accounts

To use the Service, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@musicbiz.studio if you suspect any unauthorized use of your account.

You must provide accurate and complete information when creating your account. You may not impersonate another person or use a name you are not authorized to use.

4. Credits and Payments

The Service operates on a credit system. Each song analysis consumes one credit. Credits can be purchased individually or as part of a bundle. Pro subscribers receive unlimited analyses for the duration of their active subscription.

• Non-refundable credits: Purchased credits are non-refundable, except in cases where an analysis fails due to a technical error on our end. In that event, the credit consumed will be returned to your account.
• Subscriptions: Pro subscriptions are billed monthly and auto-renew unless cancelled. You may cancel your subscription at any time through your account settings; cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused subscription time.
• Pricing changes: We reserve the right to change pricing with reasonable advance notice.

All payments are processed by Stripe. By making a purchase you also agree to Stripe's Terms of Service.

5. Acceptable Use

You agree not to use the Service to:

• Upload audio content for which you do not hold the necessary rights, licenses, or permissions. You are solely responsible for ensuring you have the right to submit any content to the Service.
• Attempt to reverse-engineer, scrape, or otherwise abuse the Service or its underlying APIs.
• Use automated scripts or bots to submit analyses in bulk without prior written authorization.
• Circumvent any rate limits, access controls, or authentication mechanisms.
• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.

We reserve the right to suspend or terminate accounts that violate these terms.

6. Intellectual Property

You retain full ownership of all rights to your music and audio content. By uploading content to the Service, you grant us a limited, non-exclusive, royalty-free license solely to process your audio file for the purpose of generating your analysis.

We do not use your audio files to train AI models, build datasets, or for any purpose other than generating your requested analysis. Your music remains yours.

The Service itself, including its design, software, and analysis output format, is owned by MusicBiz.Studio and protected by applicable intellectual property laws.

7. Privacy

We collect your email address when you create an account, and we temporarily store the audio files you upload in order to perform analysis. Audio files are processed by the Google Gemini API and are deleted from our storage after a defined retention period.

8. Disclaimer

All analysis results are generated by artificial intelligence and are provided "as-is" without warranty of any kind. AI-generated analysis may be inaccurate, incomplete, or not reflect the views of music industry professionals.

The Service is intended as a creative tool and starting point for artists. It is not a substitute for professional music industry advice, A&R feedback, or legal counsel. We make no guarantees regarding the accuracy, usefulness, or commercial viability of any analysis output.

9. Limitation of Liability

To the fullest extent permitted by applicable law, MusicBiz.Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the total amount you paid us in the twelve months preceding the claim.

10. Changes to Terms

We may update these Terms of Service from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of the Service after changes are posted constitutes your acceptance of the revised terms. We encourage you to review this page periodically.
